Hey boys and girls,

I got a speeding ticket, 77km/h in a 50km. I don't intend on forking over $131.25 to the government. Any advice would be appreciated=)

Anyone a Lawyer here?

Uh oh....tsk tsk! I would suggest going to the justice of the peace (i think that's what it's called) and ask them to lower the charge....hopefully no points were taken.

Get others opinions too...I haven't had a speeding ticket, I'm just going by what I've heard others do.

27km/h over?

exceeding the limit by 16km/h - 29km/h is 3 demerit points + fines. found that here: http://www.xcopper.com/demerit.html

i say try to ask the court to lower your fines so that you don't get demerit points. if your insurance finds out, those demerit points will kill you more than the fines. OR if you have a court date setup already, try to keep delaying the court date and hope that the cop loses track and doesn't show.

you can sometimes go to court and tell them you are a starving student, etc.etc. can't afford to pay. they usually drop it way down.

Just FYI

Point loss has nothing to do with insurance rates (that 's a complete myth)

Insurance companies only know that you got a speeding ticket (ie. 27km over is considered a minor traffic violation, doing 100km over the speed limit is wreak less driving or major traffic violation) Get what I'm saying.

They don't know about the specifics of the offence, just the severity (major, minor, DWI, or accident)

Another good tactic (If you know you are screwed anyways)......................If you can postpone the court date until 3months after you insurance renewal, your insurance company cant increase your rates until the next renewal. (delays insurance increase)

This comes in handy if..... you already have on ticket that is almost off your record, and you want to make sure that ticket is gone before the new ticket is know by your insurance company. This way you will only have one ticket on your record when your renewal comes around instead of two (big diff in rates having two tickets instead of one)

Evo, like i told BumbleG, You can go to court, and plead guilty with an explanation or since it is your 1rst offence you can do a 1rst offence notice. You discuss the charge with the crown prosecutor and you can get the fine/points lowered, or they can send it to court.

Please take my advice.
I am experienced.

Goto the courthouse and set a court date. Don't plea bargain cause you don't even want this ticket on your records. You don't need a lawyer just rep yourself.

The court date will arrive in three to four weeks.
You can play games and request a new court date to try to screw the system but I prefer not to. Make sure you take note of all the conditions that existed at the scene. In court you can provide these descriptions and use them as a possible reason for your mistaken speed or a reason for why you needed to increase your speed.
Plead with the court and mention that you are a first time offender who has a degree/job/family.
Oh and dress professionally.

2b) Plea guilty, ask that the charges be lowered. Use &quot;I've learnt my lesson and won't do it again&quot; story. They've heard it all before so it won't matter much. Pay a reduced fine, and hopefully there are no points.

Do not bother going to the ticket fighters unless you have no time. They do the exact same thing as I mentioned above. Instead of 2b, they'll buy the prosecutor a coffee and have a chat about the weather. Usually, they have a stack of tickets from all their clients when they see the prosecutor. Then they'll go through each ticket and ask that the charges be dropped or reduced. Because of this business as usual approach, they really don't care much about your ticket. If they manage to drop the charges, you pay them, if they don't, you pay the gov't. Either way, you're paying.

If you are guilty of the crime, suck it up and pay the fine. (try to have it reduced and try to get away without losing demerits).

Scour the ticket and look for spelling mistakes, boxes not checked etc.....

From what I remember from long time ago the charges are dropped if the cop does not show.

If they say that the cop should have another chance you can say that you are ready now and that you had to take a day of work/school or whatever but you cant do it again.

I may be wrong my last ticket was 6 years ago.

If you're comfortable doing it yourself, then I'd go with what others are suggesting i.e. try to plea the charge down.

However, if you're not the outgoing personality type, you can call HWY Law (they're out in Scarberia somewhere) to get you off the charge - reasonable rates (moreso than X-Copper, or any of those other guys). These guys have gotten me off twice in the past...

Actually Protege5girl you are mistaken.

If you plead not guilty and the cop is a no show then all charges are dropped because there is no one to prove you wrong.

I had an asshole cop pull me over last year and gave me 4 tickets

-85km in a 60km zone
-improper exhaust (too loud)
-improper licence plate (inside on dash)
-windshield obstruction (yellow vinyl strip across top of windshield)

The stupid ass cop was at another court date so he didn't show up....I got away from $480 in tickets and 2 or 3 demerit points!


Stupid idiot...I wish I could see him again so I could offer to buy him a coffee and donut on the money he saved me....LOL

Really dumb question, are you guilty, or does that not matter? Just asking, because I paid the two tickets I had years ago because I was guilty as charged.
Does honesty suck nowadays or is it just not cool?

Please......the courts are no place for honesty.

If the punishment was fair, then I would probably pay the ticket.

When you have to pay out the ass to insurance companies for the next three years and pay 50% annually more than you should be then you lie your ass off.

I asked about this 1st offence notice thing.

No one's ever heard of it.

If I go to the court house do I ask for &quot;1st offence notice&quot; or what??

Does it matter that I already asked for a court date?

I am with him, this works, I know people that have done it or you can also go to court on that day with a friend, if you recognize the cop then have you friend go up when they call your name and have him tell the judge that you were not able to attend due to some personal problem or illness, would like to reschedule for another day, make a doctors appointment for that day and complain about headache,.  Most judges will accept it.

Chances are your first court date will be when the cop is due in court for the week. Your rescheduled date will be when the next available date is and usually it's six months down the road and most times that cop is not scheduled so your charges will be drop.

Either what Sameer said or you could also go there (in case the cop remembers you) and say that you were suppossed to have representation and the guy/girl did not show up so its not your fault but you cannot proceed.
It works once though.

Always plea not guilty and hope for the best. If dodging the actual case does not work the worst that can happen is if you please not guilty and they say you are you can still bargain for lower fine. Sometimes the cop will show up and find you and offer you a deal before. it happened to me once. He said plea guilty to the ticket with no points and I will drop the ticket with points.

Either way you will gain something.
