I got into a car accident this weekend, and my car is most likely totaled. Although the insurance adjuster has yet to see it, there is extensive damage to the subframe, engine bay and roof.

...details + pics to follow.

My question is that I got charged with "Careless driving" and I was wondering what should I do at this point?

Also, since I have not been convicted of "Careless driving", am I obligated to inform the insurance company of my ticket?

I don't know details,.....but I'm guessing the first thing you should do is look into finding yourself a lawyer.

I don't think careless driving is something that you can just talk your way out of. And even if it might be,...you probably don't want to take the chance. But then again,...what do I know? Is it just a charge, or are there demerit points involved (I'm guessing there's probably some points). Maybe see if you can get in touch with any witnesses,......if you're lucky enough to have had some around,....and might be able to contact them.

Oh,...and not to sound like a vulture or anything,...but if you're car ends up being a write-off and you're looking to sell off any parts,....be sure to post,....I'd glady find a loving, tender, and caring home for them http://msg.toprotege.com/iB_html/non-cgi/emoticons/wink.gif

As stated before I'm not sure what happened but chances are if you weren't doing something stupid you'll get it lowered.

I rearended some lady who stopped on a green last sept. and was charged with Careless.

In court the charges were lowered to "Failure to turn left to avoid an accident." I took those charges gladly rather then face the careless.

i once was charged careless drivin' 2months after i have my G2, i got a lawyer fought down to unsafe lane change...
it was a big different....
from 6 demirit point to only 2....
the fine is minor, but demirit points is the
most important...if they charge u more points,
tat means ur insurance goes up much higher~

ps. sellin' ne stock parts?? lookin' for a pair of seat brackets....and a driver side pillar

Seems kinda rude to be grabbing parts off of his just-totalled car don't you think?

Even so no one can claim any parts. Once the adjuster has commited the car to the scrap heap the only thing the original owner can do is remove his or her "personal belongings" or buy the car out of the scrap heap and salvage it, and that is a lot of work to do....it would need to be taken to the ministry after repairs are done to get approval for the road again. and the insurance company will only cover half of the damages then.

No one in their right mind would recover a Protege from the scap heap.

Oh and EvolutionIV, Don't go to your insurance with the ticket untill you have ben CONVICTED. If you go before then you dig yourself a hole for the future.
And with the charge itself.....do what everyone else has sugested....get a lawyer and don't let him make your rules.....try to get no demerit points taken off. this will keep your insurance down low.

nooooooooooooo! harold you ok? even though your car is totalled, i hope that your physical self is ok... that's always and most important.

as for your careless driving ticket, get a lawyer to rep you right away. you do not want to be in a situation where you need representation but do not have any. i hope that it's not too serious and that the situation can be resolved in a timely and orderly manner.

if you can and don't mind, please include the details of the accident. this way, other members can give more input and insight on what to do from here.

Yo, you need to explain your accident here..

When i totalled my 2002 the cop was going to charge me with careless... EVEN THOUGH IT WAS NOT MY FAULT... keep in mind its because there wasn't any other witnesses that could back my claim.. Fortunately, I was so fumed up with this stupid fag of a truck driver, that I started cussing the cop out telling him how rediculous the charge was, and why in gods name i would want to total my $45,000 car...

He finally realized how stupid the charge was, and he dropped all tickets, and my insurance also said it was 0% at fault thus no premium increase.

Dude i warn you, nomatter how expensive the lawyer is, get it.. A careless driving charge + a total wreckage of vehicle may result in third party insurance... Please tell us how you got into this accidentt..

hope eveyone is ok. take eveyones advice get a lawyer first, then with thier help decide what to do.

Find out everything you can. Go take pictures of the accident site. write down as much as you can remeber. Weather, lighting, road conditions,

Photocopy your ticket and submit it to court ASAP. You only have 15 days to do it.

careless is 6 dermerits, cops usually throw that at you when your the only one involved and you must have hit something pretty damn bad

a lawyer would cost you 3k to even 10k cuz they will 100% get you out of the hole (these guys aren't ticket fighters, they are lawyers)

ticket fighter guy you pay 2 bills will likely lower the charge to &quot;failing to drive on one lane&quot; or something gay like that, usually down to 3 - 4 points

sry to throw reality @ u, careless driving is one under drinking &amp; driving/hit &amp; run (i think those are criminal)
and there is no way insurance won't know about it, its a biggy and insurance won't let you go

but look on the bright side! at least your ok, life is one's most precious

hope you are doing okay. for sure get a lawyer. you messed up and he/she can save you from the worse. people do it all the time. make the investment, cause the initial investment is worth it. driving records have a way of screwing you over for life!
